Jaunty Consulting, LLC complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. Jaunty Consulting, LLC has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Jaunty Consulting’s data collection falls under the jurisdiction of the Federal Trade Commission of the USA, and we are committed to the principles of Privacy Shield. This privacy notice applies solely to information collected, except where stated otherwise. It will notify you of the following:
· What information we collect;
· With whom it is shared;
· How it can be corrected;
· How it is secured;
· How policy changes will be communicated; and
· How to address concerns over misuse of personal data.
Information Collection, Use, and Sharing
We are the sole owners of the information collected for this research. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone. Working with pharmaceutical and biotech organizations, Jaunty Consulting will only share data at the aggregate, and in no instances will individual data be provided.
We will use your information (e.g. Name, Email Address, Home Address) to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to complete the interview. For example, information may need to be shared with recruitment agencies for purposes of paying honoraria for your participation and upon your consent, and may include: first name, last name, phone number, email address, and mailing address. When we transfer your information to third party companies (e.g. recruitments agencies), we will ensure they maintain the same level of security as us.
Please note that upon receipt of a valid judicial instruction, we may be required to release your information to law enforcement. In cases of onward transfer to third parties of data of EU and Swiss individuals received pursuant to the EU-US and SW-US Privacy Shield, Jaunty Consulting remains liable.
Unless you ask us not to, we may contact you via email in the future to tell you about specials, new services, additional research opportunities or changes to this privacy policy. Jaunty Consulting will hold on to your information for 24 months (2 years) following initial contact.
Your Access to and Control Over Information
You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number provided below:
· See what data we have about you, if any.
· Change/correct any data we have about you.
· Have us delete any data we have about you.
· Express any concern you have about our use of your data
Sharing
We share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person.
Security
We take precautions to protect your information. When you submit sensitive information, your information is protected both online and offline.
Only employees who need the information to perform a specific job (e.g. moderating, analytics) are granted access to personally identifiable information. The computers/servers on which we store personally identifiable information are kept in a secure environment.
Notification of Changes
Whenever material changes are made to the privacy notice you will be informed in writing via email or postal mail.
Other Provisions
We are fully compliance with the EU General Data Protection Regulation (or GDPR), which describes different situations where we are allowed to collect or reuse your personal information:
· We have a contract with you – for example, a contract for completion of an interview or survey
· We are complying with a legal obligation
· When data processing is in your vital interests – for example, when this might protect your life
· To complete a public task – mostly relating to the tasks of public administrations such as schools, hospitals, and municipalities
· When there are legitimate interests
· In all other situations where we ask for your agreement (known as "consent") before We collect or reuse your personal data.
When we ask for your consent, you have to make a clear action agreeing to this, for example by signing a consent form or selecting yes from a clear yes/no option.
It is not enough to simply opt out, for example by checking a box saying you don't want to receive marketing emails. You have to opt in and agree to your personal data being stored and/or re-used for this purpose.
You will also be given the following information before you decide to opt in:
· Information about Jaunty Consulting, including their contact details, and the contact details of the Data Protection Officer (DPO) if there is one
· The reason why we will use your personal data
· How long we intend to keep your personal data
· Details of any other company or organization that will receive your personal data
· Information on your data protection rights (access, correction, deletion, complaint, withdrawal of consent)
All this information will be presented in a clear and understandable way.
If you previously gave us your consent to use your personal data, you can contact the data controller (the person or body handling your personal data) and withdraw your permission at any time. Once you've withdrawn your permission, we can no longer use your personal data.
When are processing your personal data on the basis of our own legitimate interest or as part of a task in the public interest or for an official authority, you may have the right to object. In some specific cases, public interest may prevail and we may be allowed to continue using your personal data. For example, this could be the case for scientific research and statistics, a task performed as part of the official role of a public authority.
In all cases, you should always be given information about the right to object to the use of your personal data the first time that we contact you.
Dispute Resolution

If you are unhappy with how we deal with your complaint, or the outcome, you may invoke binding arbitration or refer your complaint to a data panel.
Finally, as a last resort and in limited situations, EU individuals may seek redress from the Privacy Shield Panel, a binding arbitration mechanism.
Although it is the policy of Jaunty Consulting, LLC to not collect HR Data, we nonetheless commit to cooperate with EU data protection authorities (DPAs) and comply with the advice given by such authorities with regard to human resources data transferred from the EU in the context of the employment relationship. With respect to any complaints relating to this Policy that cannot be resolved through Jaunty Consulting LLC’s internal processes, we have agreed to cooperate with the European data protection authorities and to participate in the dispute resolution procedures of the panel established by the European data protection authorities to resolve disputes pursuant to the Privacy Shield Principles.
